Privacy Policy

This Privacy Policy explains how Guiden LLC ("Guiden," "we," "us," or "our") collects, uses, shares, and protects personal information when you use the Guiden platform, websites, and related services (collectively, the "Service"). It applies to all users, including Creators (those who upload, sell, or distribute content) and Learners (those who access or purchase content).

By using the Service, you acknowledge the practices described in this Privacy Policy. If you do not agree, do not use the Service. This Privacy Policy is incorporated into the Guiden Terms of Service (Creator and Learner) and the Acceptable Use Policy.

  • We collect information you provide (account, profile, payment), information generated by your use of the Service (including AI conversations, course progress, and analytics), and limited technical information from your device.
  • We use this information to operate the Service, deliver content and AI features, train Guiden's own proprietary AI models scoped to the Service, generate analytics for Creators about their Learners, secure the Service, comply with law, and (with your permission where required) market our Service.
  • We do not sell your personal information for money. We do share certain information with advertising partners in ways that may be considered "sharing" or "selling" under California and similar state laws. You can opt out (see Section 9).
  • We do not use your data to train any third-party foundation AI model (such as the underlying models from third-party AI providers we use).
  • You have rights regarding your personal information, including the right to access, delete, and opt out of certain processing. To exercise rights, contact legal@guiden.ai.
  • The Service is intended for users 18 years of age or older.

1. Information We Collect

1.1 Information You Provide to Us

  • Account information: name, email address, phone number (where provided), password, profile photo or avatar, date of birth or age confirmation, and (for Creators) company name, role, and social media handles.
  • Profile and learning information: information you add to your profile, learning preferences, goals, experience level, and any responses to onboarding or in-course questionnaires set up by Creators.
  • Payment and transaction information: billing name and address, transaction history, and payment instrument details. Full payment card details are collected and stored by Stripe, our payment processor, and are not stored on Guiden's systems.
  • Communications: messages you send to Guiden support, feedback, survey responses, and content of communications with Creators sent through the Service.
  • Customer Content (Creators only): courses, videos, audio, text, images, and other materials Creators upload to the Service.

1.2 Information We Generate or Collect Automatically

  • AI interaction data: questions, prompts, responses, conversation logs, ratings, edits, follow-ups, and metadata for all interactions with AI-powered features of the Service.
  • Usage data: pages and content viewed, features used, time spent, completion progress, clicks, scroll behavior, search queries, course performance, and other engagement signals.
  • Device and technical data: IP address, device identifiers, browser type and version, operating system, language preferences, referring URLs, and approximate location derived from IP address.
  • Cookies and similar technologies: see Section 7 (Cookies).

1.3 Information from Third Parties

  • Payment information from Stripe (such as transaction confirmation, fraud signals, and payout status).
  • Authentication information if you sign in through a third-party provider (we receive only what the provider discloses, typically name, email, and account ID).
  • Marketing and advertising information from advertising partners (such as conversion events and audience matches).
  • Information from public sources (such as social media handles a Creator publicly associates with their brand).

2. How We Use Information

We use personal information for the following purposes:

  • To provide, maintain, secure, and improve the Service, including delivering Creator content and AI features.
  • To train, fine-tune, evaluate, and develop Guiden's own proprietary AI models, features, and products that are scoped to the Service. We do not use your data to train third-party foundation AI models (see Section 3).
  • To generate analytics, insights, recommendations, benchmarks, and reports for the Creator whose content you access, including data about your engagement, common questions, content performance, and learning outcomes.
  • To process payments, issue refunds, manage subscriptions, prevent fraud, and resolve billing disputes.
  • To communicate with you about your account, transactions, security, customer support, product updates, and (with your consent where required) marketing.
  • To personalize your experience, including recommendations, content discovery, and reminders.
  • To enforce our Terms of Service, Creator Content & Course Rules, and Acceptable Use Policy, and to investigate and prevent fraud, abuse, and security incidents.
  • To comply with legal obligations, respond to lawful requests from authorities, and protect our rights, property, and the safety of users and the public.
  • To generate aggregated and de-identified data and statistics for any lawful purpose, including business operations, research, and reporting.

3. AI Features and How We Use Your Data with AI

This section explains specifically how your data is used in connection with our AI features. It supplements Section 2.

3.1 What Data Powers AI Features

  • Creator content: Customer Content uploaded by Creators is processed and used to configure AI features scoped to that Creator's account, so the AI can answer Learner questions in that Creator's voice and based on that Creator's content.
  • Learner interactions: questions, prompts, conversation logs, ratings, and follow-ups between Learners and AI-powered features.
  • Creator interactions: prompts, generated outputs, and edits when Creators use AI features to build or refine their content.
  • Usage and engagement signals across the Service.

3.2 What We Do With This Data

  • Operate AI features for the applicable Creator's account, including generating responses for that Creator's Learners.
  • Train, fine-tune, evaluate, and improve Guiden's own proprietary AI models, features, and capabilities — including safety and quality models, classifiers, retrieval systems, and other models that improve the Service for all users.
  • Generate analytics and insights for the applicable Creator about their own Learners (such as common questions, content gaps, and engagement patterns).
  • Develop new features and products.

3.3 What We Do Not Do

  • We do not use your data to train third-party foundation AI models. The third-party generative AI providers we use (currently Google Cloud's Vertex AI for the Gemini family of models) are configured so that data sent to them is not used to train or improve their underlying models.
  • We do not share Learner-identifying personal information with Creators other than the Creator whose content the Learner is accessing.
  • We do not sell your AI conversations or personal information for money.

3.4 Retention of AI Data

We retain AI interaction data and other usage data for as long as your account is active. When you delete your account, we delete or de-identify your AI interaction data within a reasonable period, subject to retention required for legal, security, fraud prevention, backup, and accounting purposes. Aggregated and de-identified data derived from your interactions may be retained indefinitely and used for any lawful purpose.

4. How We Share Information

4.1 Service Providers

We share personal information with third-party service providers ("subprocessors") who perform services on our behalf, such as hosting, storage, payment processing, AI processing, video processing, transcription, email delivery, analytics, and customer support. Subprocessors are contractually required to protect personal information and use it only for the purposes we authorize.

Our current core subprocessors include:

  • Stripe, Inc. — Payment processing, fraud prevention, payouts to Creators.
  • Google Cloud (Vertex AI) — Generative AI features (Gemini), embeddings, vector search.
  • Amazon Web Services — Hosting, storage (S3), database (Aurora), CDN (CloudFront), application infrastructure.
  • AWS Elemental MediaConvert — Video transcoding and processing of Creator course content.
  • Amazon Transcribe — Transcription of Creator-uploaded video and audio for AI ingestion.
  • SendGrid (Twilio) — Transactional and marketing email delivery.
  • Analytics providers — Product analytics, usage measurement, performance monitoring.
  • Advertising partners — Advertising attribution, conversion measurement, retargeting.

4.2 Creators (Sharing of Learner Data)

If you are a Learner, the Creator whose content you access receives information about your account, your engagement with their content, and your AI interactions with their AI features. This is necessary so the Creator can deliver, support, and improve the course you purchased.

4.3 Advertising and Analytics Partners

We share certain information (such as device identifiers, IP address, page URLs, and conversion events) with advertising and analytics partners (such as Google, Meta, and TikTok) to measure the effectiveness of our marketing, attribute conversions, and show you relevant ads on other sites and services. These activities may be considered "sharing" or "selling" of personal information under California and similar state privacy laws. See Section 9 for your opt-out rights.

4.4 Legal, Safety, and Compliance

We may disclose personal information if we believe in good faith that disclosure is necessary to comply with a law, regulation, subpoena, court order, or other legal process; enforce our Terms of Service or Policies; detect, prevent, or address fraud, security, or technical issues; protect the rights, property, or safety of Guiden, our users, or the public; or report content involving the safety of minors to NCMEC or other authorities as required by law.

4.5 Business Transfers

If Guiden is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, personal information may be transferred to the successor or acquiring entity, subject to the protections of this Privacy Policy or with notice to you where required.

4.6 With Your Consent

We may share personal information for other purposes with your consent or at your direction.

5. Data Retention

We retain personal information for as long as your account is active and as needed to provide the Service. After account deletion, we delete or de-identify personal information within a reasonable period, subject to retention required for legal and regulatory compliance; security, fraud prevention, and abuse investigation; defense of legal claims; backups and disaster recovery; and aggregated and de-identified data, which may be retained indefinitely.

6. Security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit and (where applicable) at rest, access controls, logging, monitoring, and vendor due diligence. No security program is perfect, and we cannot guarantee absolute security. To report a suspected security issue, contact legal@guiden.ai.

7. Cookies and Similar Technologies

We and our service providers use cookies, pixels, software development kits (SDKs), and similar technologies to operate the Service, remember your preferences, measure usage, and support advertising. Cookie categories include:

  • Strictly necessary: required for the Service to function (login, security, payment).
  • Functional: remember preferences and improve user experience.
  • Analytics: measure how the Service is used so we can improve it.
  • Advertising: support advertising attribution, measurement, and retargeting.

You can control cookies through your browser settings and, where available, through our cookie consent banner. If you are in a jurisdiction that requires opt-in consent for non-essential cookies (such as the EU/UK), we ask for your consent before setting non-essential cookies. Disabling cookies may affect Service functionality.

8. Children

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe a child under 18 has provided personal information to us, please contact legal@guiden.ai and we will take appropriate steps to delete it.

9. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information. We honor these rights for all U.S. users to the extent practicable, regardless of state of residence.

9.1 Rights You May Have

  • Right to know and access: request a copy of the personal information we hold about you.
  • Right to correct: request correction of inaccurate personal information.
  • Right to delete: request deletion of your personal information, subject to legal exceptions.
  • Right to portability: request a copy of your personal information in a portable format.
  • Right to opt out of "sale" or "sharing" for cross-context behavioral advertising (see Section 9.3).
  • Right to limit use of sensitive personal information.
  • Right to non-discrimination for exercising your rights.
  • Right to appeal a denial of a privacy request (where applicable under state law).

9.2 How to Exercise Your Rights

To exercise any of these rights, email legal@guiden.ai with your request, the email address associated with your account, and the right you wish to exercise. We will verify your identity before fulfilling the request and will respond within the time required by applicable law (generally 45 days, with possible extension).

9.3 "Do Not Sell or Share" / Opt-Out of Targeted Advertising

  • Use the "Do Not Sell or Share My Personal Information" link in our website footer (where available).
  • Configure your browser to send the Global Privacy Control (GPC) signal, which we will honor as a valid opt-out request for the device and browser from which it is sent.
  • Email legal@guiden.ai with the subject "Opt Out of Sale/Sharing."

9.4 California Residents (CCPA/CPRA)

California residents have the rights described above and additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. We do not knowingly sell or share personal information of consumers we know to be under 16.

9.5 Other State Laws

Residents of Virginia, Colorado, Connecticut, Texas, Utah, and other states with comprehensive privacy laws have rights similar to those described above. To exercise these rights, contact legal@guiden.ai.

10. International Users

The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, processed in, and stored in the United States, where data protection laws may differ from those of your country. Where required by law (such as for users in the European Economic Area, United Kingdom, or Switzerland), we rely on appropriate transfer mechanisms such as Standard Contractual Clauses.

11. Marketing Communications

With your consent where required, we and Creators may send you marketing emails, SMS messages, and push notifications about the Service, courses, features, and promotions. You can opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email, replying STOP to any marketing text, or disabling push notifications through your device settings. Opting out of marketing does not affect transactional or service-related communications.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last Revised" date and, for material changes, provide additional notice. Your continued use of the Service after the effective date constitutes acceptance.
