Creator Content & Course Rules

Rules every Guiden Creator agrees to when uploading content. These supplement the Guiden Terms of Service and apply to all Creators, instructors, and account holders who upload, generate, host, sell, distribute, or promote content using the Service.

This document supplements the Guiden Terms of Service (the "ToS") and applies to all Creators, instructors, account holders, and any individuals or entities who upload, generate, host, sell, distribute, or promote content using the Guiden platform (the "Service"). These Rules are incorporated into the ToS by reference. In the event of conflict between these Rules and the ToS, the ToS controls.

Guiden enforces these Rules to protect Learners, Creators, payment processors, and the integrity of the Service. Violations may result in content removal, feature restrictions, suspension, or termination as described in Section 7.

1. Content Rights and Ownership

Creators must own all content uploaded to Guiden or have all necessary rights, licenses, consents, and permissions to use, distribute, and commercially exploit it through the Service. Creators may not upload copyrighted, licensed, trademarked, or otherwise restricted material without proper authorization, including third-party music, video clips, images, logos, fonts, software, course materials, books, or branded content.

2. AI Use and Creator Responsibility

  • Creators are solely responsible for reviewing, verifying, and approving AI-generated outputs before publishing, distributing, or relying on them.
  • Creators must not configure or use AI features to provide individualized medical, legal, financial, trading, mental health, or other regulated professional advice unless properly licensed.
  • Creators must not attempt to extract, scrape, copy, or train external AI models on content, prompts, outputs, embeddings, or other data accessed through the Service.
  • Creators must not misrepresent AI-generated content as exclusively human-created where doing so would be misleading or deceptive under applicable law.

3. Prohibited Content and Conduct

Creators may not upload, host, sell, distribute, or promote content or courses that include, promote, facilitate, or instruct any of the following. This list is illustrative, not exhaustive.

3.1 Illegal or Harmful Activity

  • Instructions for crimes, fraud, theft, hacking, identity theft, evading law enforcement, or laundering funds.
  • Drug manufacturing, distribution, sale, or misuse, including unregulated nootropics and research chemicals.
  • Cannabis, CBD, kratom, psychedelics, or other controlled substances, except where properly licensed, lawful in jurisdictions of sale, and compliant with the Payment Processor's rules.
  • Weapons construction, modification, conversion, 3D-printed firearms, illegal modifications, or unlicensed firearms training.
  • Violence, threats, incitement, or instructions for inflicting physical harm.

3.2 Financial, Trading, and Investment Content

Guiden permits trading, investing, and financial education content, including signal services, copy trading, prop trading education, and trading rooms, subject to all of the following conditions.

Permitted with Conditions

  • Trading and investing education, market analysis, and technical or fundamental commentary.
  • Trading signal services, alert rooms, and copy trading services, provided they comply with the conditions below.
  • Prop trading education, funded account preparation, and challenge guidance.
  • Backtested or historical performance, provided it is clearly labeled and accompanied by a disclaimer that past performance does not guarantee future results.

Required Disclosures and Conditions

  • All trading, investing, and financial content must include clear, conspicuous disclaimers that the content is for educational purposes only, is not personalized investment advice, and that trading involves substantial risk of loss.
  • Creators must not present themselves as licensed financial advisors, broker-dealers, or registered investment advisors unless they actually hold those licenses and disclose them.
  • Affiliate relationships with brokers, prop firms, signal providers, or platforms must be disclosed in compliance with FTC Endorsement Guides.

Strictly Prohibited

  • Guarantees of profits, risk-free returns, no-loss claims, or specific income promises (e.g., "make $10K a month guaranteed").
  • Fabricated, misleading, or selectively curated screenshots, P&L statements, or trading results.
  • Insider trading, market manipulation, pump-and-dump schemes, wash trading, or any conduct that violates SEC, CFTC, FINRA, or equivalent foreign regulations.
  • Unlicensed personalized investment advice presented as professional or fiduciary guidance.
  • Securities offerings, token sales, ICOs, or solicitation of investment in any private fund, pool, or vehicle.
  • Sports betting picks or gambling systems marketed as guaranteed wins or income strategies.

3.3 Health, Fitness, and Wellness Content

Permitted with Conditions

  • General fitness instruction, training programs, exercise demonstrations, and athletic coaching.
  • General nutrition education, meal planning frameworks, and lifestyle guidance, when clearly framed as educational.
  • Mindset, productivity, and general wellness coaching.

Required Disclosures

  • Health, fitness, and nutrition content must include a disclaimer that the content is not medical advice and that Learners should consult a qualified healthcare professional before starting any program.
  • Creators must not represent themselves as licensed medical, mental health, or nutrition professionals unless they actually hold those licenses.

Strictly Prohibited

  • Diagnosing, treating, curing, or claiming to prevent any disease, medical condition, or mental health disorder.
  • Prescribing or recommending prescription medications, dosing protocols, or off-label drug use.
  • Anti-vaccination content, content discouraging professional medical care, or content promoting unproven cures.
  • Eating disorder content, including extreme caloric restriction, purging, or other content that could cause harm to vulnerable Learners.
  • Content involving steroids, SARMs, peptides, or other unregulated performance-enhancing substances framed as use guidance.

3.4 Legal, Tax, and Immigration Content

  • General legal education, explainer content, and document templates are permitted.
  • Personalized legal, tax, or immigration advice presented as a substitute for a licensed professional is prohibited unless Creator is properly licensed and discloses jurisdiction.
  • Content instructing Learners on how to evade laws, taxes, regulatory obligations, court orders, or immigration enforcement is prohibited.

3.5 Adult and Explicit Content

  • Pornographic or sexually explicit material is prohibited.
  • Escorting, sexual services, or content that solicits or facilitates the same is prohibited.
  • Sexually suggestive content involving real or implied minors is prohibited under any circumstance.

3.6 Child Safety (Zero Tolerance)

ANY CONTENT THAT SEXUALLY EXPLOITS, ENDANGERS, OR DEPICTS THE ABUSE OF MINORS IS STRICTLY AND ABSOLUTELY PROHIBITED.

Guiden has zero tolerance for child sexual abuse material (CSAM), grooming behavior, or any content that endangers minors. Violations will result in immediate termination, preservation of evidence, and reporting to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement, as required by 18 U.S.C. § 2258A and applicable foreign law.

3.7 Hate, Harassment, and Extremism

  • Hate speech or discriminatory content targeting individuals or groups based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or other protected characteristics.
  • Harassment, bullying, doxing, threats, stalking, or targeted abuse of any individual.
  • Promotion, glorification, or recruitment for extremist organizations, terrorist groups, or violent ideologies.

3.8 Intellectual Property Violations

  • Pirated, stolen, or unlicensed courses, videos, music, books, software, or other copyrighted material.
  • Repackaged, scraped, or substantially copied content from other Creators, platforms, or sources without authorization.
  • Trademark infringement, including unauthorized use of brand names, logos, or marks.
  • Counterfeit goods, replica products, or content promoting the same.

3.9 Deceptive, Predatory, and Misleading Practices

  • Pyramid schemes, Ponzi schemes, chain referral schemes, or multi-level marketing recruitment as the primary product.
  • Get-rich-quick programs, business opportunities, or income systems with unsubstantiated earnings claims.
  • Fake testimonials, fabricated case studies, paid reviews not disclosed as such, or AI-generated testimonials presented as real.
  • Impersonation of individuals, brands, institutions, government agencies, or other Creators.
  • Deepfakes, voice clones, or synthetic media depicting real people without their consent, except for clearly satirical, educational, or commentary purposes consistent with applicable law.

3.10 Technical Abuse

  • Malware, spyware, ransomware, viruses, exploit code, or instructions for creating the same.
  • Instructions to bypass paywalls, DRM, authentication, rate limits, or other security or access controls, including those of the Service.
  • Use of Guiden, Customer Content, or any data accessed through the Service to train, fine-tune, build, or improve any AI model, system, or service outside the Service.
  • Scraping, crawling, harvesting, or automated extraction of data from the Service except through documented APIs as permitted.
  • Reverse engineering, decompiling, or attempting to derive the source code, models, prompts, or system configurations of the Service.

3.11 Restricted and High-Risk Industries

The following categories require Creators to comply with applicable law, the Payment Processor's terms, and any additional requirements Guiden may impose.

  • Cryptocurrency, NFTs, DeFi, and Web3 content.
  • Gambling, sports betting, casino strategies, and daily fantasy sports.
  • Forex and futures content.
  • Firearms, ammunition, and tactical training (where permitted by law and the Payment Processor).
  • Adult-adjacent content (e.g., dating coaching, pickup artistry) where it does not violate Section 3.5.
  • Multi-level marketing or network marketing education.
  • Religious or faith-based content (permitted broadly, but content that promotes violence, hatred, or harm to specific groups violates Section 3.7).

4. Marketing, Claims, and Advertising Compliance

  • All claims must be truthful, accurate, and substantiated. False, misleading, or deceptive claims are prohibited.
  • Creators must comply with the FTC Act, the FTC Endorsement Guides, the CAN-SPAM Act, the TCPA, GDPR (where applicable), and all other applicable advertising and consumer protection laws.
  • Testimonials and case studies must reflect actual results from real customers. Atypical results must include clear disclosure (e.g., "results not typical").
  • Affiliate, sponsorship, and material connection disclosures must be clear, conspicuous, and proximate to the endorsement.
  • Income claims, earnings examples, and lifestyle claims must be substantiated and accompanied by appropriate disclaimers.
  • Email, SMS, and other direct marketing must comply with applicable opt-in, opt-out, identification, and unsubscribe requirements.

5. Creator-Learner Relationships and Non-Circumvention

  • Creators must publish a clear refund policy and honor it consistently.
  • Creators must respond to legitimate Learner inquiries and disputes in good faith and within a reasonable time.
  • Creators must not use the Service to solicit Learners acquired through Guiden to migrate off-platform for the primary purpose of avoiding Guiden's fees during the period the Learner is an active subscriber or within 90 days of cancellation.
  • Creators must not collect, scrape, or export Learner contact information through the Service except as expressly permitted by Guiden's tools and applicable privacy law.
  • Creators must not disparage Guiden, the Service, or other Creators in a manner that is false, defamatory, or intended to harm Guiden's business.

6. Platform Integrity and Account Conduct

  • Creators may not bypass usage limits, billing systems, plan tiers, or technical safeguards of the Service.
  • Creators may not create multiple accounts to evade enforcement, fees, or limits.
  • Creators are responsible for all activity under their account, including activity by team members, assistants, contractors, and any sub-users.
  • Creators must not attempt to access another Creator's account, content, AI configurations, or Learner data.
  • Creators must not use Guiden to build, train, support, or compete with Guiden or any substantially similar service.
  • Creators must cooperate in good faith with Guiden investigations into suspected violations.
  • Creators may not claim that Guiden endorses, sponsors, or partners with them, and may not use Guiden's trademarks, logos, or brand identifiers except as expressly permitted.

7. Enforcement, Removal, and Appeals

Guiden may, in its sole discretion and without prior notice, take any of the following actions in response to a violation:

  • Remove, restrict, or disable access to specific content.
  • Restrict, suspend, or disable specific features or AI capabilities.
  • Suspend or terminate Creator's account.
  • Withhold, delay, or reverse payouts pending investigation, in accordance with Section 4 of the ToS.
  • Report Creator to the Payment Processor, law enforcement, or other authorities where required or appropriate.
  • Pursue any other legal or equitable remedy available.

Severe violations, including those involving child safety, fraud, illegal content, or threats to platform integrity, may result in immediate termination without notice or opportunity to cure.

Appeals

Creators may request review of an enforcement decision by emailing legal@guiden.ai within 14 days of the action, including the affected account, the action being appealed, and any relevant context. Guiden will review such requests in good faith but reserves final and binding discretion.

8. DMCA and Copyright Compliance

Guiden complies with the Digital Millennium Copyright Act (DMCA) and equivalent copyright laws in other jurisdictions.

Takedown Notices

To submit a valid takedown notice, the notice must include all elements required by 17 U.S.C. § 512(c)(3), including a signature of the rights holder, identification of the copyrighted work, identification of the allegedly infringing material, complainant's contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate.

Repeat Infringer Policy

Guiden will terminate, in appropriate circumstances and at its discretion, the accounts of Creators who are repeat copyright infringers. Three or more substantiated DMCA notices against a single Creator within a 12-month period generally constitutes repeat infringement.

9. Changes to These Rules

Guiden may update these Rules from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after the effective date of an update constitutes acceptance.

These Rules are incorporated into the Guiden Terms of Service and are binding on all Creators. All questions, notices, appeals, and legal correspondence should be directed to legal@guiden.ai.
